The term “Maldives Yacht Rally” or “us” or “we” refers to the owner of the website, Maldives Integrated Tourism Development Corporation (MITDC). Our company registration number is C1043/2016 at Ministry of Economic Development, Maldives. The term “you” refers to the user or the viewer of our website.

BOOKING CONDITIONS:

  1. The Contract

    This contract is made between Maldives Integrated Tourism Development Corporation (“the Company”) duly registered in the Republic of Maldives, and any person(s) (“the Participant”) booking with the Company to take part in the Maldives Yacht Rally (“the Event”). All bookings are subject to these terms and conditions and it is agreed between the Participant and the Company that any contracts will be construed in accordance with Laws of the Maldives .

    Information given by the Participant in the online registration form, forms the basis of a contract and the Participant will be accepting the booking conditions for themselves and members of their party. If any part of these booking conditions is found to be invalid or unenforceable then the remainder of these booking conditions will remain valid and enforceable.

  2. Bookings

    Bookings can be made online via the Event’s website. Due date for bookings is until 31st day of January 2022.

  3. Balance of Payment

    Full payment will be required at the time of booking. If full payment is not received by the due date for bookings, the Company reserves the right to cancel the booking without further notice.

  4. Cancellation – By the Participant

    Cancellation by the Participant must be in writing and is effective upon receipt by the Company. In the event of cancellation by the Participant the following charges shall apply:

    1. More than 90 days from the event start date: 20% of Event participation fee
    2. Less than 90 days from the event start date: 40% of Event participation fee
    3. Less than 30 days from the event start date: 75% of Event participation fee

    Cancellation by the Participant must be in writing and is effective upon receipt by the Company. In the event of cancellation by the Participant the following charges shall apply:

    4.1 Refunds

    1. In the invent of cancellation by the participant, the cancelation will be approved by the Company within 14 days. Refund will be processed within 5 working days from the approval.
  5. Cancellation – By the Company
    1. The Company will not normally cancel, postpone or reschedule the Event less than 90 days prior to the start of the programme except for unusual or unforeseen circumstances beyond its control, Force Majeure, war or disease or Government advisories. In the event of cancellation by the company, a full refund will be given to the Participant.
    2. In case of any changes in the Maldives COVID-19 regulations, evaluated by the Health Protection Agency and beyond the control of MITDC, a full refund will be given to the participant.
  6. The Participants obligations
    1. Details supplied on the registration from and booking page are accurate.
    2. The Participant is required as a booking condition to take out a personal travel insurance package that covers, injury and medical expenses. The policy must also include cover for sailing and of the Event.
    3. The Participant agrees to abide by the normal operating and safety procedures as laid down by any suppliers of accommodation in the Maldives or abroad and any yacht clubs or official bodies and charter companies that may be used or associated with as part of the package.
  7. Limitation of liability

    The Company will use vessels that are in required for the event they are entered into. Where such vessels are obtained by the Company as skippered or bareboat charters the Company will endeavour to ensure all required safety and survey requirements are met but the Company will not be held responsible for any defects or omissions by the vessels owner or managing agents. The Company will accept liability for the negligence of its employees causing injury or death to the extent that it is obliged to under the Maldives law. The Company shall not be liable for any injury, death loss or damage caused by other Participants, nor will it be responsible for any uninsured losses of the Participant’s property, nor for any illness, injury or death sustained during the Event. Participants agree if required to complete a release of liability form before embarking on the Event if required to by the Company.

  8. Authority

    The Participant agrees to accept the authority, decisions and instructions of the Company’s Skipper’s, employees, agents and representatives during the Event. The Skipper has full authority to decide when to sail, with regard to weather conditions and the well-being of the crew, or to return to port after the commencement of a passage due to the above or defects to the yacht at any time at their discretion and their decision is final.

  9. Age Limit

    The Skipper or Owner of the vessel should be on 18 years old at the commencement of the Event unless pre-arranged with the Company. Any children under eighteen years olds as crew members are allowed to be participants in the Event with a responsible guardian.

  10. Health

    Sailing can be a dangerous activity and requires an average level fitness and health. Where doubts exist as to the health of the Participant, they may be required to provide a medical certificate to the Company on request at any time.

    Participants must be fully vaccinated and must provide the vaccination cards if requested by the respective authorities of Maldives including but not limited to Ministries, Maldives Police Service, Local Councils, other organisations, and members of the public relating to the Yacht Rally and its activities.

  11. Safety & Conduct

    Safety – The Company is dedicated to the safety of all crew and staff at all times. Therefore, as a Participant you will be expected to follow the safety procedures as outlined by the Skipper.

    Conduct – The Company requires respectful conduct from its Participants in relation to the use of services and goods provided by the Islands, other organisations, and members of the public relating to its activities.

    You should be aware of the safety and emergency procedures and general operating procedures of any organisations involved in the Event and adhere to them.

    Prohibited substances – Any use or possession of banned substances will be dealt with by expulsion from the event and will be reported to the relevant authorities.

    Breakages and Loss – Resulting from negligence or wilful damage will be paid for by the offenders.

  12. Media releases and image rights waiver

    Crew members, employees and participants grant the Company and affiliated companies and organisations the absolute right and permission to use their name, voice, image, likeness, biographical material as well as representations of the yachts in any media (being television, print and internet media), including video footage, for the sole purposes of advertising, promotion, reporting and disseminating information regarding the Company and affiliated companies.
